1. Who we are

This Website (“Site”) is operated by Bapcor Limited (ABN 80 153 199 912) and its related entities (“Bapcor Group”). In these Website Terms of Sale (“Terms of Sale”), the expressions “we”, “us” and “our” refer to the members of the Bapcor Group.

2. Acceptance of these terms

Your access to and use of this Site, including your order of goods and services (“Products”) through this Site, is subject to these Terms of Sale.

3. Changes to these terms

We amend these Terms of Sale from time to time. Every time you wish to purchase Products from our Site, please check these Terms of Sale to ensure you understand the terms that apply at that time.

4. Ordering Products online

You may order Products by selecting and submitting your order through this Site in accordance with these Terms of Sale.

Any order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified at the time you place the order.

We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through this Site.

By placing an order for Products on this Site, you acknowledge and agree that we may send you survey and feedback emails in relation to your order and/or Products. You may opt out of such emails by clicking the unsubscribe link in the emails.

5. Acceptance or Rejection of an order

Our acceptance of your order for Products made on this Site results in an agreement between you and us for the supply of those Products in accordance with these Terms of Sale.

We reserve the right to accept or reject your order in extenuating circumstances, including (without limitation) suspected fraud, if the requested Product is not available, if there is an error in the price or incorrect product information.

If we reject an order placed through this Site, we will endeavour to notify you of that rejection within a reasonable time after you submit your order.

6. Accuracy of Products and Descriptions

We try to ensure that information provided through the Site is accurate and current. However, we cannot, and do not, represent or warrant the accuracy, adequacy, completeness of information on this Site or that it is up to date. For example (but without limitation):

  1. Prices and colours of products may change, and all products are subject to availability;
  2. Descriptions of products are summaries only (with further information available on request to us);
  3. We may withdraw any product from sale for any reason, however that product might still appear on our website for a period of time after that withdrawal;
  4. Due to technical or human error, information may be recorded incorrectly or omitted.

If a Product offered by us is not as described, your sole remedy is to return the Product in an unused condition to us for a refund.

7. Delivery of Products

Delivery fees are payable in addition to the purchase price of each Product. A number of different delivery methods may be used depending on the type of order.

We aim to deliver Products to your nominated place of delivery (“Delivery”) requested by you within the time indicated by us at the time of your Order, but we can’t absolutely guarantee firm Delivery dates or times.

We will try to let you know if we expect to be unable to meet our estimated Delivery date or time, but to the extent permitted by law, we will not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late or delayed Delivery.

Our delivery partners may contact you via SMS or email prior to delivery to provide you with different delivery options, including giving "authority to leave" the item at the address, or have delivery re-routed to a collection point. Unless otherwise specified, all risk in the product shall pass to you upon Delivery. From the time when risk passes to you, we will not be liable for loss or destruction of the Product.

We currently ship orders to Australian addresses only.

8. Cancelling an order

Click and Collect: You may cancel an order up to the moment it is collected. Orders that are not collected within a reasonable time after an order is placed, may at our reasonable discretion be cancelled.

Delivery: You may cancel an order if it has not yet been dispatched by contacting our customer service team via our Contact Us page. You cannot cancel all or any part of an order after the order has been dispatched by us. Whilst we make every effort to accommodate cancellation requests, sometimes this may not be possible depending on the timing of the request being submitted and processed and the stage of the order fulfilment process.

Made to order Products cannot be cancelled once an order has been submitted.

9. Returns

We offer a Return Policy, where you may be able to return Products for a refund or exchange. Please refer to the process detailed on the Returns page of this Site. If you have received a product with a defect, please contact our Team via our Contact Us page as soon as possible so we can guide you through the returns process and help resolve the problem as swiftly as possible. In order to assist the return process, you may be required to send us images of the damage, defect or fault for preliminary assessment. You may be asked to provide further information to support your claim to assist us with our assessment of the goods. Special orders, made to order, backorders or drop shipped, or clearance Products will only be accepted for return due to a change of mind at our discretion and / or the discretion of our Customer Service Team. If these Products are accepted for return a return fee may be payable by you.

10. Low Price Guarantee

We offer a Low Price Guarantee. Please refer to the process detailed on the Low Price Guarantee page of this Site for further details.

11. Warranty and Liability

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality, and the failure does not amount to a major failure.

Any advice, recommendation, information or representation provided by us as to the quality or performance of Products or their suitability for a particular purpose or otherwise in relation to the Products is given in good faith but without any liability or responsibility on our part. You acknowledge you have not relied upon or been induced by our representations.

To the fullest extent permissible at law, we disclaim all responsibility for any damages or losses (including, without limitation, financial loss, damages for loss in business projects, loss of profits or other economic losses) whether arising in contract, tort or otherwise from the use of, or inability to use, this Site, or any material appearing on this Site, or from any action or decision taken as a result of using this Website, the Services or any such material.

12. Your obligations

You covenant and warrant that:

all information and data provided by you to us through the Site (including as part of the customer registration process) or otherwise is true, accurate, complete and up to date;

the person receiving the Products at the delivery address is authorised by you to do so; you have and will comply with all relevant laws relating to your use of the Site and your placement of any order to us;

you will ensure that any login and password that is used to access the Site and the details of your account is kept in a safe and secure manner; and

you will promptly notify us if you are or become aware that there is or has been an unauthorised use of your login and password or account, or any other security breach relating to your account;

you will promptly advise us of any changes to your information provided to us as part of the customer registration process;

13. Severability

In the event that any provision of these Terms of Sale is determined to be unlawful, void or unenforceable, the balance of these Terms of Sale0shall be enforced to the fullest extent permitted by applicable law, and the enforceable portion of these Terms of Sale shall be deemed to be severed from these Terms of Sale, such determination shall not affect the validity and enforceability of any other remaining provisions.

16. Gift Cards

These terms and conditions (T&Cs) apply to all gift cards and electronic vouchers issued by or on behalf of Bapcor Retail Pty Ltd, trading as Autobarn, (each a “Gift Card”). By purchasing, redeeming or attempting to redeem a Gift Card, you agree to the following T&Cs.

  1. Gift Cards are redeemable at participating Autopro retail stores located within Australia. Gift Cards may not be redeemed at Autopro’s online retail store: https://autopro.com.au.
  2. Gift Cards may be available for purchase in Autopro's retail stores. A customer can nominate the value they wish to load onto the Gift Card, with a minimum value of $20 and maximum of $999. The value loaded to a Gift Card includes GST (if any).
  3. Unless otherwise stated on the Gift Card, Gift Cards are valid for use within 3 years from the date of issue (Validity Period). Any balance that remains on a Gift Card after the Validity Period will not be available for use.
  4. To check the expiry date of your Gift Card and remaining balance, call 1300 554 268 or visit https://autoprogiftcards.viisolutions.com.au/CheckBalance/CheckBalance.
  5. Gift Cards will be issued with a PIN number. In order for a Gift Card to be redeemed, the customer must provide the associated unique PIN number at time of redemption. If a PIN number cannot be provided, the Gift Card may not be able to be redeemed.
  6. Gift Cards may only be applied up to the maximum value loaded onto the Gift Card which is unspent at the time of use. Where the cost of purchase exceeds the available balance of the Gift Card, the excess amount must be paid by another payment method.
  7. Subject to your rights under the Australian Consumer Law. Gift Cards are non-refundable.
  8. Gift Cards may be redeemed in whole or part during the Validity Period. Where used in part, no change will be given. Any unused balance may be used against future purchases, but will not be refunded or credited when the Gift Card expires.
  9. Gift Cards may not be: used to pay a store or credit account. Redeemed or exchanged for cash, further gift cards, or any other form of currency.
  10. Gift Cards may not, without the prior written consent of Autobarn be resold or offered for resale at a premium (including via online auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, without the prior written approval of Autobarn. If a Gift Card is sold or used in breach of this condition, Autopro may in its reasonable discretion cancel or render invalid the Gift Card without a refund and the Gift Card holder may be refused redemption of the Gift Card.
  11. Autopro may cancel or render invalid any Gift Card (including any available balance) which Autopro determines in its absolute and sole discretion was purchased at any time and in any way (including via online auction or other unauthorised resale sites) by fraudulent means. You acknowledge and agree that you will not be entitled to redeem any available balance on any fraudulent Gift Card and that Autopro will not be obliged to hold such balance on file for you or otherwise redeem or exchange that Gift Card.
  12. You are responsible for the use and security of your Gift Card and PIN number. Lost or stolen Gift Cards may not be replaced or refunded. Lost or stolen PIN numbers cannot be reissued or replaced. You are liable for all transactions on your Gift Card except those caused by fraud or negligence by Autobarn or its employees.
  13. Defaced, mutilated or altered, lost or stolen Gift Cards may not be accepted, replaced or refunded.
  14. Personal information collected in relation to your Gift Card will be handled in accordance with our Privacy Policy.
  15. The laws of Victoria, Australia apply to these T&Cs and any disputes arising in relation to them.
  16. Questions or problems relating to Gift Cards should be directed to the Gift Cards Care Team via our contact page. Complaints about purchases made with a Gift Card should be resolved directly with the store concerned.
  17. To the extent permitted by law Autopro reserves the right to amend these T&Cs at any time, including, without limitation, changes to add or remove participating retailers and/or where the Gift Card may be redeemed. The amendments will apply to any transactions that take place after the amendments take effect.
